Terms of Use
The short version. This website is a shop window, not a shop. You cannot buy anything on it, and nothing here forms a contract. Orders are agreed directly with the bakery, and the terms of your actual order are whatever you and the bakery agree at that point.
1. Accepting these terms
By using this website you agree to these terms. If you do not agree with them, please don’t use the site. You’re still very welcome to call the bakery.
2. What this website is
This site is informational. It describes what Buttercup’s Baking Society bakes, roughly what it costs and how to get in touch. It does not take payment, hold accounts, confirm availability or accept bookings, and no part of it commits the bakery to fulfilling any particular order.
3. Orders are agreed separately
Submitting the contact form or calling the bakery is a request, not a confirmed order. An order exists only once the bakery has confirmed it directly with you, including the item, the date and the price. Until then nothing is reserved.
How far ahead to order
Three days’ notice is enough for a typical order. Larger orders need longer, and busy weeks fill up, so the earlier you ask the better. If a date cannot be met you will be told when you ask, not at the last minute.
Paying
Payment is due when you collect your order. Nothing is charged through this website, and the bakery will never ask you for card details by email or text.
Deposits
Everyday orders need no deposit. Orders of $100 or more take a 25% deposit to secure the date. The deposit is part of the price, not an extra charge: on a $200 order it is $50, leaving $150 to pay at collection. Special or unusually large orders are agreed case by case, and anything different will be told to you in writing before you commit.
Cancelling
If you cancel an order that carried a deposit, the deposit is not returned. By that point the date has been held for you and, close in, ingredients have already been bought. Everyday orders carry no deposit, so cancelling one costs you nothing; even so, a message as soon as you know is a real kindness to a one-person kitchen.
If the bakery cancels, you get everything back. Illness, an oven failure or anything else at this end means a full refund of any deposit. The deposit protects the bakery against a change of mind, not against its own failure to deliver.
Collection and delivery
You can collect your order free of charge; the pickup address is given once the order is confirmed.
Delivery is available on orders of $50 or more, and costs $25 within 10 miles of Decatur or $45 within 20 miles. Further out than that, ask, and you will be told plainly whether it can be done. Delivery is to the address you give, at a time agreed in advance, and someone needs to be there to receive it.
Orders are held for 24 hours from the agreed collection time. After that the order may be disposed of, any deposit is not returned, and the balance is no longer owed. This is a food safety limit as much as a scheduling one: fresh baking made in a home kitchen is not something that should be handed over after sitting out longer than that. If you are running late or something has gone wrong, call or text (940) 278-7667 and it will almost always be sorted out.
4. Prices
The pricing page lists starting prices for the usual sizes. Those are a general guide to help you judge whether to get in touch. They are not a quotation and not an offer. Size, decoration, flavor and timing all affect the final figure, and the only binding price is the one the bakery confirms to you for your specific order.
5. Photography on this site
Please read this one. The photographs currently on this website are licensed stock images used to illustrate the style and range of what the bakery makes. They are not photographs of Buttercup’s Baking Society’s actual products, kitchen, staff or customers. Your order will not be an exact reproduction of any image shown here. Full source details for every image are recorded in the project’s IMAGE_SOURCES.md file.
What the bakery agrees to bake is described to you in words when the order is confirmed. A photograph is never a guarantee of what will be produced.
6. Reviews shown on this site
The quotations in the "Kind words" section are genuine feedback from real customers, published with their permission and shown with a first name and last initial. They are not drawn from Google, Yelp, Facebook or any other review platform, and no star rating or review count is claimed anywhere on this site.
7. The chat helper
“Sprinkles” is an automated helper powered by an AI language model. It can be wrong. Nothing it says is a quote, a confirmed order, or advice you should rely on, and it cannot accept or confirm an order. Where its answer matters, check with the bakery directly. Allergy and dietary questions are deliberately not answered by it at all.
8. Food, allergens and safety
Nothing on this website is an allergen statement. Baked goods commonly contain wheat, eggs, dairy, nuts and soy, and a home kitchen is a shared space in which cross-contact is possible. If you have an allergy or intolerance, speak to the bakery directly before ordering and rely on what it tells you, not on this site.
Every product is supplied with an ingredient and allergen label. The exact label wording should be checked against the cottage food requirements that apply where the bakery operates.
9. The order form
The form on the home page sends your request to the bakery as an email, delivered through Brevo, a transactional email provider. Nothing you type is stored on this website. If sending fails, the form falls back to opening your own email app so your request is not lost. Sending the form starts a conversation: it does not place or confirm an order, and nothing is baked until Kim replies with flavors, size and a price and you agree to them.
10. Links to other websites
This site does not link out to any third-party ordering, booking or payment service. If one is added later, it would be operated by that third party under its own terms and privacy policy, and Buttercup’s Baking Society would not be responsible for its content, availability or handling of your information.
11. Intellectual property
The Buttercup’s Baking Society name, logo and the wording of this site belong to the bakery and may not be reproduced without permission. Stock photographs remain the property of their respective photographers and are used under the Pexels License. The two typefaces used are open-source and licensed for web use.
12. Acceptable use
Please don’t attempt to disrupt, scrape, overload or gain unauthorised access to the site, and don’t use it to send unlawful, abusive or misleading content.
13. Availability and accuracy
The site is provided as-is. The bakery aims to keep it accurate but does not guarantee it will always be available, error-free or up to date. Descriptions, prices and lead times can change, and the bakery may update or withdraw any part of the site at any time.
14. Limitation of liability
To the fullest extent permitted by law, Buttercup’s Baking Society is not liable for indirect or consequential loss arising from your use of this website. Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud.
This clause concerns the website. Liability relating to food supplied to you is a matter for your order terms and for applicable consumer and food-safety law, and is not limited here.
15. Governing law
These terms are governed by the law of the State of Texas, and disputes will be handled in the courts of Wise County, Texas, where the bakery operates.
16. Changes
These terms may be updated from time to time. The "Last updated" date above will change when they are, and continuing to use the site means accepting the current version.
